Acceptance of Terms.
Welcome to the Heartland Cyber Range (“HCR”). The HCR was created and is maintained by EnterpriseKC. These Terms of Use ("Terms") are a binding legal agreement between you and the HCR, and govern your use of the services, software, and any facilities provided by the HCR. By accessing or using the HCR, you agree to be bound by these Terms.

Definitions.
a. Cyber Range: a simulated digital environment provided for cybersecurity training, research, and development (the Heartland Cyber Range is referred to as the HCR).
b. User: any individual or entity accessing or using the HCR.

Use of the HCR.
a. Users are granted a non-exclusive, non-transferable, revocable license to access and use the HCR for the purpose set forth in paragraph 2(a).
b. Users must utilize the HCR solely for lawful, authorized testing, training, and educational purposes.

Age Restrictions.
a. If a User is 13 years old or under, any use of the HCR must comply with the provisions of the Children’s Online Privacy Protection Act (“COPPA”), with all such compliance being the sole responsibility of the User’s parent or guardian.
b. If you are under 18 years old, you may only use the HCR with the involvement of a parent or legal guardian.

User Responsibilities.
a. Users are responsible for maintaining the confidentiality of their account credentials.
b. Users must immediately report any unauthorized use of their account or any other breach of security.
c. Users should treat the HCR and fellow users in an ethical, respectful manner, and act with the best interests of both in mind.
d. Users shall use the HCR in a manner consistent with all applicable laws and regulations.

Prohibited Activities.
a. Attempting to disrupt the HCR, other users, or any outside/third party entity.
b. Sharing login information or attempting to gain unauthorized access to another user’s account.
c. Engaging in illegal activities or conducting any testing on third-party systems without prior written consent from the system owner.
d. Attempting to interfere with the proper functioning of the HCR.
e. Engaging in any hacking or other malicious activities designed to compromise the security of the HCR.
f. Engaging in any offensive or inappropriate behavior including, but not limited to posting or circulating racist, hateful, sexist, pornographic or otherwise objectionable material.

Data Handling and Privacy.
Users agree to adhere to all applicable data protection and privacy laws. User data collected will be handled in accordance with our Privacy Policy.

Intellectual Property.
a. Unless otherwise stated, all intellectual property rights in the HCR, its software, and all materials provided are owned by EnterpriseKC. Content cannot be reused or disseminated outside of its intended use on the Cyber Range without prior written approval from EnterpriseKC.
b. Users are granted a non-exclusive, non-transferable, revocable license to use the Cyber Range for its intended purpose.

Submission of Content.
By uploading or submitting content, users agree that:
a. All submissions and their contents along with related intellectual property rights will automatically become the property of the Heartland Cyber Range, without any compensation provided.
b. The Heartland Cyber Range may use or redistribute the submissions and their contents for any purpose and in any way on an unrestricted basis.
c. There is no obligation for the Heartland Cyber Range to review the submissions.
d. There is no obligation to keep any submissions confidential.

Limitation of Liability.
EnterpriseKC is not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or other intangible losses arising from your use of the HCR.

Modifications to Terms.
a. EnterpriseKC reserves the right to modify these Terms at any time.
b. Continued use of the HCR after such changes will constitute acceptance of the new Terms.

Governing Law.
These Terms are governed by the laws of the state of Kansas, without regard to its conflict of law principles.
